Heard Sri Kuldip Singh Chauhan, learned A.G.A. appearing for the State and perused the records.

By means of the present appeal, the appellant is assailing the legality and validity of the judgment and order of acquittal dated 15.02.2024 passed by the learned Additional District & Sessions Judge/Fast Track Court-I/Women Harassment, Bhadohi while deciding the Sessions Case No.345 of 2021 (State of U.P. Vs. Vimlesh and another) arising out of case crime no.394 of 2019, under Section 326-A/34 IPC, P.S. Bhadohi, District Bhadohi.

It is worthwhile to point out that the informant Lal Bahadur has also filed Criminal Appeal U/S 372 Cr.P.C. No.228 of 2024 and the said appeal was rejected by the same Bench of this Court on 08.05.2024 by a well reasoned order.

Imbibing and transporting the same reasoning adopted in Criminal Appeal U/S 372 Cr.P.C. No.228 of 2024, this appeal would also meet the same fate and accordingly, in this view of the matter, we reject the application for leave to appeal filed under section 378(3) Cr.P.C.

Re : Government Appeal

Consequently, since, the Criminal Misc. Application (Leave to Appeal) has been rejected by order of this date, the present government appeal is also dismissed.
