Heard learned counsel for the petitioner, learned State Counsel for opposite party No. 1 and Mr. Rishabh Tripathi learned counsel for opposite parties 2 and 3.

Petition has been filed challenging order dated 25th October, 2023 and seeking a direction to opposite parties for grant of benefit of promotion from Assistant Grade-III to Assistant Grade -II notionally from the date of his entitlement on 20.9.2003 in terms of Rule 16(3)(ii)(c) of Chapter - II of the Service Regulation of the Corporation framed under the U.P. Forest Corporation Act, 1974.

Learned counsel for petitioner submits that petitioner is covered by judgment and order dated 21.12.2023 passed in writ A No. 9694 of 2023,Vimla Arora versus State of U.P. and others.

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file a fresh representation before the concerned authority which shall be considered and decided within a period of eight weeks from the date a certified copy of this order is submitted before the said authority, who shall extend the same benefits as has been granted in the case of Vimla Arora (supra) in case petitioner is similarly situated.
