Heard Sri Avadhesh Kumar, learned counsel for the petitioners and learned Standing Counsel appearing for the respondents.

There is consensus at the bar that the matter in issue is squarely covered by the judgment of this Court passed in Writ-C No.3000058 of 2003 in re: Vijai Shanker and Another vs. State of U.P. and others, whereby the writ petition was dismissed as withdrawn with liberty to the petitioners to avail the remedy available to them as may be permissible under the law and thus it is prayed that similar order may also be passed in the instant petition.

Accordingly taking into consideration the aforesaid consensus, the present petition is dismissed as withdrawn with liberty to the petitioners to avail the remedy available to them as may be permissible under the law.
