2. No one appears on behalf of the appellant to press this appeal despite the fact that there are three learned counsels appearing in the matter.

3. Learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellant Anuj against the judgment and order dated 03.06.2006 passed by Additional District and Session Judge (Fast Track Court No.2), Azamgarh in Sessions Trial No. 358 of 2001 (State Vs. Vipin and others), Police Station Atraula, District Azamgarh.

5. As per office report dated 18.08.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 10.07.2023 informed that the appellant - Anuj has died in the year 2017. The said report has been sent after due enquiry.

6. Accordingly, the appeal stands abated.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks from today.
