Earlier on 06.10.2023, the following order was passed:-

"Ms. Anjali Thakur holding brief of Mr. Rahul Chaudhary, learned counsel appearing on behalf of respondent-Bank has raised a preliminary objection regarding maintainability of the writ petition against the private bank. She has placed reliance upon a judgment passed by Co-ordinate Bench of this Court in Misc. Bench No. - 21265 of 2020 (Arif Khan vs. Branch Manager Mahindra Finance Sultanpur and Another) in support of her submission.

To the aforesaid, learned counsel for the petitioner prays for and is granted time to prepare the case.

Put up this case on 16.10.2023 as fresh."

Today, on seeing the petition being not maintainable, learned counsel for the petitioner prays to withdraw this petition.

Accordingly, the writ petition is dismissed as withdrawn.
