Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondents no. 1 & 2, Sri Ran Vijay Singh, learned counsel appearing for respondents nos.3 and 4 and Sri Prashant Kumar Singh, learned counsel appearing on behalf of the respondent no.5.

There is consensus at bar that the matter in issue is squarely covered by the judgment of this Court passed in Writ-A No. 7709 of 2023 Inre; Smt. Sushma Pandey Vs. State of U.P and Ors, decided on 10.10.2023.

Accordingly taking into consideration the aforesaid consensus, the present petition is disposed of in light of the aforesaid judgment passed in the case ofSushma Pandey (supra).

It is provided that the petitioner would also be entitled for the benefit of the judgment ofSushma Pandey (supra).
