Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

Petition has been filed seeking a direction to the opposite parties to provide pensionary benefits to petitioner counting services rendered by him as a Seasonal Collection Amin with effect from Ist March, 1989.

It is submitted that petitioner was regularized in service on 27th February, 2019. He has adverted to judgments rendered by co-ordinate Bench of this Court in Writ A No. 4344 of 2023 Ishwar Chand Sharma and others versus State of U.P. and another as well as division Bench judgment rendered in Special appeal (defective) No. 564 of 2020, State of U.P. and others versus Suresh Chandra Pandey and others as well as Special Appeal no. 475 of 2020, State of U.P. and others versus Prabaht Kamal.

For the aforesaid grievance, the petitioner has already submitted a representation but seeks liberty to file a fresh representation before the concerned authorities.

Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 3 i.e. District Magistrate/Collector, Lakhimpur Kheri. In case such a representation is filed, the same shall be decided in the light of aforesaid judgments in case same are applicable within with period of eight weeks from the date a copy of this order is produced before the said authority.

With the aforesaid observations, the writ petition stands disposed of.
