2. Heard Sri Ankit Singh, learned counsel for the applicant and Sri Ajai Singh, learned A.G.A.-I for the State and perused the material on record.
3. This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant-Deepak Prajapati, seeking enlargement on bail during trial in connection with Case Crime No. 265 of 2016, under section 376 I.P.C. and Section 4 of Protection of Children from Sexual Offences Act-2012, Police Station Sajeti, District Kanpur Dehat.
4. A short counter affidavit dated 04.10.2023 has been filed by learned counsel for the State which is taken on record.
5. While placing paragraph 9 of the said affidavit and Annexure No. CA-1 to the same being the judgment and order dated 30.09.2023 it is argued that the trial in the matter is concluded and the accused applicant has been convicted therein.
6. In view of the paragraph 9 of the short-counter affidavit, the present bail application is dismissed as infructuous.
