1. Supplementary affidavit on behalf of applicant, filed today, is taken on record.

2. Heard learned counsel for the applicants and perused the record.

3. The suit filed by the applicant was decreed by the Court below. Against the judgment of Court below, a first appeal was preferred by the opposite party, which is pending before this Court. The Appellate Court had directed for deposit of certain amount by the appellant in the appeal, which according to the applicant has not been deposited.

4. This court finds that the remedy available to the applicant by filing case for execution of the decree and no case for contempt is made out.

5. The contempt application is misconceived and is hereby dismissed.
