Petitioner is aggrieved for non-payment on the post of Principal of the institution while his signatures have come to be attested on 2.6.2022, a copy whereof has been brought on record as Annexure-5 to the petition.
Petitioner thus has been working as officiating Principal of the institution and is entitled to the payment of salary as admissible for the post of Principal of the institution in the light of Full Bench judgment of this Court in the case of Dr.Jai Prakash Narayan Singh vs. State of UP, 2014 (8) ADJ 617.
It transpires from the record that the petitioner has already approached the District Inspector of Schools in this regard by moving separate applications.
Learned Standing Counsel submits that he has no objection in the event direction issued to the District Inspector of Schools to pass appropriate orders in accordance with law.
In view of the above, this petition is disposed of with the direction to the District Inspector of Schools to pass a reasoned and speaking order expeditiously, preferably, within a period of three months from the date of production of a certified copy of this order. The petitioner, if is held entitled to payment of salary for the post of Principal in accordance with law, the same shall be paid to him immediately after taking decision and the arrears be also cleared, accordingly.
