Heard learned counsel for the applicant and learned A.G.A. for the State.

The instant anticipatory bail application has been filed on behalf of the applicant, Jamwant Singh,with a prayer to release him on bail in Case Crime No. 60 of 2022, under Sections 3/5A/5B/8 of Cow Slaughter Act and section 11 of Animal Cruelty Act Police Station Pannuganj, District Sonbhadra during pendency of trial.

By the order dated 1.03.2023, the interim anticipatory bail was granted to the applicant granting time to learned A.G.A. to file counter affidavit.

Despite time granted, no counter affidavit has been filed.

For the reasons given in earlier interim order dated 1.3.2023, this anticipatory bail application is allowed.

The applicant is already on interim anticipatory bail. He shall continue in anticipatory bail on same terms and conditions as given in earlier order dated 1.3.2023 as per judgement of the Apex Court in the case ofSushila Aggarwal vs. State (NCT of Delhi)- 2020 SCC Online SC 98.

In case, the applicant misuses the liberty of anticipatory bail, the Court concerned may take appropriate action in accordance with law and judgment of Apex Court in the case ofSushila Aggarwal vs. State (NCT of Delhi)- 2020 SCC Online SC 98.
