Heard learned counsel for the petitioner and Sri Raj Mohan Upadhyay, learned Standing Counsel for the State-respondent.
In pith and substance, petitioner is before this Court with a request to direct the respondents to decide the representation dated 29.12.2022 for granting permission to run small saw machine of 3 H.P. within stipulated period in the light of judgment and order dated 19.1.2016 in Writ C No. 837 of 2011 (Rama Shankar Vishwakarma vs. State of U.P. and others).
Learned Standing Counsel fairly states in case the aforesaid representation is still pending and has not been decided, definitely, the same would be considered and decided expeditiously by the competent authority as per law.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending and with the consent of the parties, the writ petition is disposed of finally asking the competent authority to decide the aforesaid representation of the petitioner expeditiously from the date of production of a certified copy of this order before him strictly, in accordance with law and in the light of judgment of this Court in Rama Shankar Vishwakarma (supra).
