Heard learned counsel for the appellant.
Plaintiff-appellant by the instant appeal has raised challenge to the judgment and order dated 22.02.2023, passed by the Principal Judge, Family Court, District Bareilly in Case No.259 of 2020, instituted under Section 13 of the Hindu Marriage Act, 1955, whereby, Application 10-Kha filed by the defendant-respondent/wife, under Section 24 of the Hindu Marriage Act, 1955, has been allowed awarding Rs.3000/- per month to the defendant-respondent and Rs.2000/- per month to her daughter towards interim maintenance from the date of filing of the application; and one time litigation expense at Rs.2000/- and Rs.200/- payable on each date of appearance in the suit proceedings.
It is not in dispute that the respondent is legally wedded wife of the plaintiff-appellant and out of their wed-lock a female child was borne who is residing with the respondent.
In the circumstances, learned Counsel for the appellant failed to point out any illegality, perversity or jurisdictional error in the impugned order.
The appeal being devoid of merit, is accordingly, dismissed.
