Case is called out. No one has put in appearance on behalf of the petitioner to press the writ petition.
Sri Jitendra Prasad Mishra, learned Advocate is appearing for the respondent No.1 and the learned Standing Counsel appears for the State-respondents.
The dispute pertains to a letter dated 21.10.2022 written by the Sub Divisional Officer, Mauranipur, Jhansi asking the revenue team to make a fresh inspection of the site-in-question and submit a report. The said direction was issued pursuant to a judgment and order dated 12.04.2022 passed by this Court in Writ-C No.25010 of 2021.
It may be noted that in that petition, the direction was given by this Court to demarcate the plot No.280M which was allegedly utilised for construction of National Highway No.39.
We fail to understand as to how and under what circumstances, the petitioner can be allowed to challenge the communication of the Sub Divisional Officer, asking the revenue team to make a fresh inspection doubting the correctness of the previous inspection report dated 14.09.2022. Even otherwise, in case the petitioner was aggrieved by the said order of the Sub Divisional Officer, he could have approached the District Magistrate, Jhansi.
In any case, the present petition seeking quashing of the communication dated 21.10.2022 cannot be entertained and is, accordingly, dismissed on merits, in absence of the counsel for the petitioner.
