Heard Sri Ramendra Kumar Shukla, learned counsel for the petitioner and Sri Ajay Singh, learned Standing Counsel for the State.

This writ petition has been filed seeking a direction upon respondent no.3 to pay the minimum pay scale to the petitioner in view of decision of the Apex Court in Case of Sabha Shanker Dube Vs. Divisional Forest Officer and others, 2019 (1) AWC 36 (SC).

It is contended by counsel for the petitioner that a representation dated 21.09.2022 has been moved before the respondent no.3 for considering the same in the light of the judgment of Apex Court.

As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no.3 to consider and decide the representation moved by petitioner on 21.09.2022, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law keeping in mind the decision of Apex Court rendered in the case of Sabha Shanker Dube (supra), expeditiously, preferably within a period of three months from the date of production of certified copy of this order.

Writ petition stands disposed of.

It is made clear that this Court has not adjudicated the matter on merit.
