Case called out. Neither the revisionist nor his counsel is present to argue the case.
The revision pertains to the year 2011.
As per report of Stamp Reporting Section there is a delay of 8 days in filing the present revision.
The present criminal revision has been preferred by the revisionist under Section 53 of the Juvenile Justice (Care & Protection of Children) Act, 2000 against the order dated 9.9.2010 passe by learned Principal Judge, Juvenile Justice Board, Lucknow whereby bail application of the revisionist was rejected. Further against the said order a Criminal Appeal No. 2225 of 2010 was also preferred before the trial court and that too also dismissed by judgment and order dated 22.12.2010 by the learned Sessions Judge, Lucknow.
Perusal of record shows that application for condonation of delay has not been moved by the revisionist nor the delay has yet been condoned in this case.
In view of the above, delay in filing the present criminal revision is not condoned as the revision pertains to the year 2011.
Since delay is not condoned in this case and the same is hereby rejected, consequently, this criminal revision is also rejected on the ground of latches.
Office is directed to communicate this order to the court concerned for necessary compliance.
