Heard learned counsel for the applicant as well as learned A.G.A. for the State as well as perused the record.
The present anticipatory bail application has been filed by the applicant apprehending his arrest in Crl. Complaint Case No.4351 of 2015, under Section 392 I.P.C., Police Station Atrauli, District Hardoi.
Learned counsel for applicant, after arguing for some time, submits that he does not want to press this application for anticipatory bail and seeks liberty to file a regular bail application in the light of judgment of Hon'ble Supreme Court in Aman Preet Singh vs. C.B.I. through Director passed in Criminal Appeal No.929 of 2021.
Learned A.G.A. has no objection in case applicant's bail application may be decided by the trial court in the light of the judgement in Aman Preet Singh (supra).
In view of above, the application of anticipatory bail is dismissed as not pressed however, liberty is given to the applicant to move regular bail application before the learned trial court within fifteen days' from today, which shall be decided expeditiously in view of the judgment of Hon'ble Supreme Court in the case of Aman Preet Singh (Supra). The prayer for interim bail shall be considered on day one.
