This matter was mentioned before the Court was about to rise for the lunch break, indicating an urgency that the Trial Court is proceeding to deliver judgment tomorrow. Accordingly, the papers were summoned from the office. The applicant has moved this transfer application seeking transfer of Suit No. 293 of 2012, Phool Singh and others v. Smt. Meenu Maheshwari and others, from the Court of Civil Judge (Junior Division), Firozabad to any other Court of competent jurisdiction within the Judgeship of Firozabad.

Since, the transfer sought is within the Judgeship of Firozabad, going by the settled principle, the applicant had to approach the learned District Judge, Firozabad in the first instance with the relief that he now claims before this Court. In this view of the matter, this Court declines to go into the merits of the applicant?s plea for transfer, leaving the applicant free to approach the learned District Judge, Firozabad.

Accordingly, this application is disposed of with the liberty as aforesaid.

Let a copy of this order be issued to the learned counsel for the applicant within 24 hours.
