Heard learned counsel for the petitioner and learned A.G.A. for the State.
This petition has been filed by the deponent i.e. the maternal grandmother of the detenue.
It is alleged that the detenue is presently residing with respondent no. 7 who is the mother of the detenue. Learned counsel for the petitioner submits that custody of the detenue with respondent no. 7 is illegal.
It is admitted case of the deponent that respondent no. 7 is mother of the detenue who is minor aged about 18 years.
On due consideration to the judgment of this High Court passed in the case of "Amal Ifra Vs. State of U.P. and two others, Habeas Corpus Writ Petition No. 12616/2014", I am of the opinion that custody of the detenue with respondent no. 7 who is natural guardian (mother) is perfectly valid and is in the best interest of the detenue.
The petition being devoid of merits is dismissed.
