2. Heard Sri S.M.N. Abbas Abedi, learned counsel for the appellant and Sri Ajay Singh, learned counsel for the State.

3. The present appeal under Section 374 Cr.P.C has been preferred by the appellant against the judgment and order dated 28.1.2006 passed by Additional Sessions Judge, Court No.3, Meerut in S.T. No.1017 of 1999 (State Vs. Kalwa).

4. As per the office report dated 5.7.2023, a report of C.J.M., Meerut dated 18.5.2023 has been received stating therein that the sole appellant Kaluwa @ Kamal Singh has died on 18.11.2012. The said report has been sent after due inquiry.

5. This Court has perused the said report which states that the accused-appellant Kaluwa @ Kamal Singh has died on 18.11.2012.

6. In view of the above, the appeal stands abated.

7. File consigned to records.

8. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
