Heard learned counsel for the applicant, learned Additional Government Advocate for the State and perused the record.
Present anticipatory bail application has been filed on behalf of the applicant in Case Crime No. 61 of 2022, under Sections 406, 504, 506 IPC, Police Station PGI, District Lucknow.
Learned counsel for the applicant, at the outset, submits that since the offences under which the FIR has been lodged are punishable upto 7 years of imprisonment, therefore, he does not want to press the present application for anticipatory bail, rather confines his prayer that he may be permitted to file regular bail application before the trial court which may be directed to be decided expeditiously in the light of judgment rendered by Hon'ble Supreme Court in the case of Satender Kumar Antil Vs. Central Bureau of Investigation and Others: [(2021) 10 SCC 773].
Learned AGA for the State have no objection to this innocuous prayer.
In view of the above, the prayer for anticipatory bail is refused.
The applicant is directed to appear before the learned trial court within two weeks from today and file regular bail application. In case, such bail application is filed, the same shall be decided expeditiously by the trial court in view of the aforesaid judgments, namely, Satender Kumar Antil(supra).
