Heard Sri K.K. Verma, learned counsel for the appellants and Sri Hari Om Singh, learned Standing Counsel for the State.
By means of the instant appeal filed under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 challenging the order dated 09.12.2022 passed by the Special Judge SC/ST Act, Sitapur whereby the learned Special Judge has allowed the application under Section 156(3) Cr.P.C. and has directed the police to register a case and carry out investigation.
The order allowing the application under Section 156(3) and directing registration of a case does not decide any matter conclusive as it would not fall within the terms ?judgment, sentence or order, not being an interlocutory order? occurring in Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
For the aforesaid reason, I find that the instant appeal is not maintainable and it is, accordingly, dismissed at the admission stage.
