This appeal has been filed by the accused appellants Darbari Lal son of Chet Ram and Ved Ram son of Summer, who have been convicted vide judgment and order dated 18.7.1981, passed by IV Additional Sessions Judge, Etah, in Criminal Sessions Trial Nos.290 of 1978 and 330 of 1979 (State Vs. Darbari Lal & Another), arising out of Case Crime No.256 of 1977, Police Station Jaithra, District Etah, and sentenced to life imprisonment under Section 302 read with Section 34 IPC and two years rigorous imprisonment Under Section 452 IPC.

A report has been submitted in the matter by the Chief Judicial Magistrate, Etah on 7.9.2022, as per which both the appellants have died. Documents in support of such conclusion has been annexed alongwith the report of the Chief Judicial Magistrate.

Since both the appellants have died during the pendency of appeal, the appeal abates and is, consequently, dismissed.
