This is the third bail application.
Heard Brij Raj Singh, learned counsel for applicant, Fakhruzzaman, learned counsel for complainant and perused the record.
The applicant has approached this Court by way of filing the present Criminal Misc. Bail Application seeking enlargement on bail in Sessions Trial No.157 of 2016 (State Vs. Ajeet Singh @ Manjul and others) arising out of Case Crime No.616 of 2013, under Sections 302/34 and 323/34 I.P.C., Police Station-Rendhar, District-Jalaun.
Applicant is facing trial under above referred Sections and he is in jail since 15.4.2015.
Learned counsel for applicant on instructions submits that statement of all the witnesses have already been recorded, however, till date judgment has not been passed. He further prayed that trial may be concluded expeditiously.
Fakhruzzaman, learned counsel for complainant has not disputed that recording of statement of prosecution witness as well as of defence witnesses have already been over.
Considering the above submissions and taking note that speedy trial is right of both the applicant and accused, therefore, while rejecting the prayers made in this bail application, on ground of seriousness of allegations and nature of evidence before trial court, trial court is directed to conclude trial and pass the judgment within a period of two months.
With the aforesaid direction, this bail application is disposed of.
Registrar (Compliance) is directed to communicate this order to the Trial Court.
