Short counter affidavit filed by Sri Jogendra Nath Verma learned counsel for O.P. No.2 is taken on record.

Heard Sri Lalit Kishore Tiwari learned counsel for the petitioner, Sri Jogendra Nath Verma and Sri Vinod Kumar Singh Additional Chief Standing Counsel for respondent State.

There is consensus at the bar that the matter in issue is squarely covered by the judgment of this Court passed at Allahabad in Writ-C No.37399 of 2022 in re:Bal Govind Patel Smarak Degree College And 3 Other vs. State of U.P. and others, decided on 20.12.2022.

Accordingly taking into consideration the aforesaid consensus, the present petition is disposed of in light of the aforesaid judgment passed in the case of Bal Govind Patel Smarak Degree College (supra).

It is provided that the petitioner would also be entitled for the benefit of the judgment of Bal Govind Patel Smarak Degree College (supra).
