Heard learned counsel for the petitioner.

The petitioner is aggrieved for prolonged pendency of execution case and, therefore, submits that misc. case no. 91 of 1985 filed by the judgment debtor/ third party under Order XXI Rule 97 of the Code of Civil Procedure, 1908 may be directed to be disposed of.

In view of above, this petition is disposed of with a direction to the Civil Judge (Senior Division), Jaunpur to decide the aforesaid miscellaneous case as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order after affording opportunity of hearing to the parties.
