None appears for the appellant to press this appeal. However, Sri Devashish Tripathi, Advocate holding brief for Sri Pratyush Tripathi, learned counsel for respondent No.1 and Sri Gyanendra Kumar Srivastava, learned Counsel for respondent No.2 are present.
This Special Appeal has been filed by the appellant with the following prayers:-
"WHEREFORE, it is most respectfully prayed that the learned Single Judge may be pleased to set aside the impugned judgment and order dated 13.2.12 passed by Hon'ble Mr. Justice Shabihul Hasnain in writ petition no.7849 (M/S) of 2011, Nikhil Garg vs UOI & Ors and the judgment and order dated 4.4.12 in Review Petition No.73 of 2012 and may further be pleased to quash the letter datd 28.9.11 of MCI (opposite party no.2 contained in annexure no.6) and the special appeal be allowed with cost."
It appears that by efflux of time, the instant Special Appeal has become infructuous.
Accordingly, the Special Appeal is dismissed as infructuous. Interim order, if any, stands vacated.
However, it is open for the appellant to move an appropriate application within two months from today, if the matter survives.
