Heard learned counsel for the applicants, learned AGA for the State and perused the record. Learned counsel for the private respondent no. 2 is present.
By means of this application u/s 482 Cr.P.C. the applicants have prayed for quashing of the N.B.W. dated 07.1.2023 in Case No. 684 of 1997 (arising out of Case Crime No. 231 of 1988, State Vs Mathura Prasad and another), under Sections 149, 307,427,504,506 IPC, P.S. Malpura, District Agra.
After arguing for while, learned counsel for the applicants submitted that the non bailable warrant has been issued against the applicants by the trial Court and the applicants are ready to appear before the trial court and hence some protection may be granted to him.
In the circumstances, the applicants are advised to appear before the trial Court for cancellation of the non bailable warrant. Applicants are directed to surrender before the court concerned within 30 days from today. In case the applicants move the application for bail on the day of the appearance or surrender, the same shall be considered and disposed of expeditiously in accordance with law in view of the judgment in the case Satendra Kumar Antil vs. Central Bureau of Investigation and another, 2021 SCC Online SC 922.
With this direction this application is finally disposed of.
