The instant review petition has been filed to review the judgment and order dated 21.05.2010 passed in Writ Petition (C) No. 68700 of 2006 (Baburam vs. State of U.P.).
It is not in dispute that against the writ court order, special leave petition bearing Special Leave Petition (Civil) No. 42573 of 2019, was preferred before the Supreme Court after a lapse of nine years in 2019, which came to be dismissed on the ground of laches by order dated 6 January 2020. Thereafter, after a lapse of two years, the instant petition has been filed. In other words, review of the writ court order has been sought after lapse of eleven years.
The ground taken in the review petition touches upon the merit of the case which cannot be gone into in review petition and that too at a very belated stage when the right of the petitioner has been crystalized.
At this belated stage, review petition cannot be entertained, accordingly, dismissed.
