Present petition has been filed challenging the order dated 12.09.2022 whereby the order of regularization passed in favour of the petitioner has been recalled by the Joint Director of Education.

Contention of learned counsel for the petitioner is that the said order is contrary to law and is without jurisdiction. He further argues that similar issue was considered by this Court while deciding Writ - A No.155 of 2023 'Vivek Singh v. State of U.P. & Ors.' decided on 27.01.2023.

Thus, on all the reasons and logic contained in the judgment passed in Vivek Singh's case (supra), the present petition deserves to be allowed and is ordered accordingly.

Impugned order dated 12.09.2022 is set aside.

The petitioner shall be permitted to continue to work and discharge his duties in accordance with law and shall also be paid his salary to which he is entitled.
