Heard learned counsel for the petitioner, learned A.G.A. for the State-respondents and Sri Dheeraj Awasthi, learned counsel for respondent no.3.
After arguing at some length, learned counsel for the petitioner states that he may be permitted to withdraw this petition with liberty to the petitioner to seek anticipatory bail under Section 438 of the Code of Criminal Procedure.
Accordingly, we dismiss the petition as withdrawn with liberty to the petitioner to approach the court concerned under Section 438 Cr.P.C. seeking anticipatory bail. Once any such application seeking anticipatory bail is made, the court concerned shall consider and decide the same, with expedition, in accordance with law and taking into account the judgment of Division Bench of this Court in the case of Gopal Mishra vs. State of U.P. and others, decided on 08.01.2021 in Criminal Misc. Writ Petition No.16343 of 2020.
