1. Heard learned counsel for the appellant, learned counsel for the respondent No.2 and learned A.G.A. for the State.

2. This appeal has been preferred under section 14-A (1) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (hereinafter referred as SC/ST Act) for setting aside the judgment and order dated 23.02.2019 including the entire proceedings, passed by the II-Additional Session Judge, Sonbhadra in S.S.T. No.67 of 2010 (State vs. Ajay alias Lala Bhuja), in Case Crime No.352 of 2010, under Section 376 IPC and Section 3(2)(5) SC/ST Act, P.S. Ghorawal, District Sonbhadra.

Learned counsel for the appellant submits that he is not pressing the appeal on merits and appeal may be disposed of with a direction to the Court below to decide the bail application of appellant expeditiously and that some interim protection may be granted to the appellant to surrender before the Court below.

4. Learned counsel for the respondent No.2 has opposed the appeal.

5. In view of aforesaid, the appeal is disposed of with direction to the trial Court that in case appellant surrenders/appears before the Court below within a period of three weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with settled law.
