Present petition has been filed seeking transfer.

Contention of learned counsel for the petitioner is that the case for transfer should be considered in terms of the mandate of Rule 8(2)(d) of the Uttar Pradesh Basic Education (Teachers)(Posting) Rules, 2008.

As the application of the petitioner is pending consideration, the present petition is disposed off directing respondents to take a decision on the application of the petitioner in terms of Rule 8(2)(d) of the Uttar Pradesh Basic Education (Teachers)(Posting) Rules, 2008, within a period of three months.

While deciding the application as directed above, the respondents shall also consider the judgment dated 03.12.2022 passed in Writ - A No.13497 of 2022.

It is made clear that the application shall not be rejected only on the ground that there is no policy prevalent at the time.
