1. Heard learned counsel for the parties.
2. By means of this petition, filed under Article 226 of the Constitution, petitioner prays for release of his gratuity amount which has been withheld on account of pending criminal case even though petitioner had retired way back in the year 2004.
3. Counsel for the petitioner submits that petitioner has now been finally acquitted vide judgment and order dated 08.04.2023 by the Sessions Trial Judge in the Criminal Case No.527 of 2022 and therefore, pleads that the withheld amount may be directed to be released forthwith. He further submits that a letter in this regard dated 21.08.2023 has been received to which petitioner has replied, however, reply of the petitioner is not on record.
4. In view of the above, this petition stands disposed of with direction that petitioner, if not replied already, shall submit his reply to the letter dated 21.08.2023 issued to him by the department within four weeks from today. On receipt of reply of petitioner, respondent shall proceed to pass final orders releasing the amount, if there is no legal impediment, in accordance with law within a further period of two months.
