3. Sri Ajay Singh, learned AGA-I for the State is present, who has been heard.

4. The present appeal has been filed by the appellant Thakur Giri against the judgment and order dated 23.02.2007 passed by Additional Session Judge/Fast Track Court No.1, Maharajganj in Sessions Trial No. 158 of 2001 (State Vs. Thakur Giri and others), Police Station Nautanawa, District Maharajganj.

5. As per office report dated 29.08.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 01.08.2023 informed that the appellant - Thakur Giri has died on 02.12.2022. The said report has been sent after due enquiry.

6. Accordingly, the appeal stands abated.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks from today.
