Heard learned counsel for the petitioners and learned Standing Counsel for the State.
The present writ petition has been filed seeking following main relief:-
"(i) Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent No. 2 to protect the life and personal liberty of the petitioners.
(ii) Issue a writ order or direction in the nature of mandamus directing and commanding the respondent No. 2 and 3 to decide the representation dated 20.10.2023 moved by the petitioner No. 1 before him expeditiously within specified period as fixed by this Hon'ble Court. "
Learned Addl.C.S.C. pointed out that in paragraph No. 5 of the petition, petitioner no.1 is already married to respondent no.4 and no documents of dissolution of marriage is filed, therefore, the case is squarely covered with the judgment of this Court passed in Asha Devi & Anr. Vs. State of U.P. and Ors. passed in Writ-C No.18743 of 2020.
Since the petitioner no.1 is already marred to respondent no.4, therefore, the matter is squarely covered with the judgment of this Court passed in Asha Devi & Anr. Vs. State of U.P. and Ors (supra) and petitioners are not entitled for any protection.
In view of above, the writ petition is dismissed.
