This petition has been filed seeking the following relief:

"i. To set aside the judgment and orders dated 6.5.2023 passed by learned District Judge, Jhansi, in Misc. Civil Case No. 99 of 2023 under Section 26(2)(ii) 3(1)(zf)/52 of Food Safety and Standards Act, 2006 (Bemisal Bakers Versus Food Safety Officer and others) as well as order dated 22.10.2022 passed by learned Justice Decision Officer/Additional District Magistrate, Jhansi in Case No. 5089 of 2021, Computerized Case No. D202106370005089, State Versus Abdul Maboob Ansari, under Section 52 of food Safety and Standards Act, 2006, Police Station-Nawabad, District Jhansi."

Learned counsel for the petitioner states that the present petition has been erroneously filed as an appeal lies under the provisions of section 71(6) of the Food Safety and Standards Act, 2006 and he, therefore, seeks leave of the Court to withdraw this petition as he will pursue his appropriate remedy.

This petition is, accordingly, dismissed.
