Heard Ms. Ninnie Srivastava, learned counsel for the petitioner.
Considering the nature of the order proposed to be passed, the issuance of notice to the opposite parties is dispensed with.
The innocuous prayer made by the learned counsel for the petitioner in this petition is for a direction for disposal of the applications under Section 151 C.P.C. for discharging the notice issued against the defendant/judgment debtor no.3 and the application under Section 151 C.P.C. filed in Execution Case No.06 of 2016 for directing the decree holder to remove the mortgaged document of the defendant/judgment debtor no.3, which are said to be pending since 2018 despite objections filed by the other side.
In view of above, without entering into the merit of the case, this petition is disposed of with direction to the court concerned to consider and dispose of the aforesaid applications filed in Execution Case No.06 of 2016 expeditiously and preferably within a period of two months after affording opportunity to the parties in accordance with law and without granting unnecessary adjournment to either of the parities.
