By way of this appeal, the Oriental Insurance Co. Ltd. has challenged the judgment and award dated 2.7.2005 passed by Commissioner, Workmen's Compensation/Dy. Labour Commissioner, Saharanpur in W.C.A. No. 02 of 2005 (Leela Wati Saini and others vs. Arjun Singh and others).

The bond of contention in this appeal is that the employees were not covered by policy. However, while going through the policy, the officers of the Insurance Company are satisfied by the finding of fact of the Tribunal that the employees were covered. This Court has also pointed out them that the matter is covered by the decision of the Apex Court in Golla Rajanna Etc. Etc. Vs. Divisional Manager and Another, 2017 (1) TAC 259 (SC).

In view of the above, this appeal is permitted to be withdrawn.

Disposed of as withdrawn.

It is submitted that 50% of the awarded amount was disbursed with security. The security be released. Learned Workmen's Commissioner at Saharanpur pass the said order within four weeks from today.

This Court is thankful to officers of the Insurance Company, Sri Ramesh Singh, learned counsel for the appellant and Smt. Sumati Rani Gupta for ably assisting the Court in getting this eighteen year old matter disposed of.

Record, if here, be sent back to the Commissioner forthwith.
