1. List revised. No one appears for the appellant to press this appeal. Sri Ajai Singh, learned counsel for the State is present.

2. The present appeal under section 374(2) Cr.P.C. has been preferred by the appellant against the judgment and order dated 01.03.2006 passed by Additional Session Judge/Vishesh Judge (E.C. Act) Pilibhit in Sessions Trial No. 657 of 2003.

3. As per the office report dated 20.07.2023 a report of CJM concerned dated 09.06.2023 has been received stating therein that the sole appellant has died. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant have died.

5. In view of the same, the appeal stands abated.

6. File consigned to records.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
