1. Matter taken up in the revised list. No one appears on behalf of the appellants to press this appeal. Sri Ram Prakash Shukla, learned counsel for the State is present.

2. The present appeal under section 374(2) Cr.P.C. has been preferred by the appellants against the judgment and order dated 17.02.2007 passed by Additional Sessions Judge, Court No. 1, Budaun in Session Trial No. 459 of 2001.

3. As per the office report dated 10.02.2021 a report of CJM concerned dated 17.08.2020 has been received stating therein that both the appellants have died. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellants have died.

5. In view of the same, the appeal stands abated.

6. File consigned to records.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
