Heard learned counsel for the petitioners.

This petition has been filed seeking the following relief:

"A) an order setting aside impugned judgment and order dated 5/5/2023 passed by the learned District Judge, Sonbhadra (hereinafter referred to as the learned lower appellate court) in Misc. Civil Appeal No. 28/2023 Quresha Begum and others V/s. Akanksha Mathur and another dismissing the appeal against judgment and order dated 31/3/2023 passed by learned Civil Judge (Junior Division) Sonbhadra (hereinafter referred to as the learned trial court) in Suit No. 652/2022 Quresha Begum and others Vs/ Akanksha Mathur and another as contained in Ann. No. 12 and 10, respectively, to the petition

B) an order restraining the respondents from making any construction in the south-west corner of the suit as demarcated by the court amin being court amin report dated 11/11/2022 as contained in Ann. No. 6 to the petition"

After arguing for sometime, learned counsel for the petitioners prays that he may be permitted to withdraw this petition as the petitioners will seek their remedy before the trial court as well as before the revenue court under the provisions of the U.P. Revenue Code, 2006.

Shri Ravi Prakash Srivastava, learned counsel for the respondent has no objection.

This petition is, accordingly, dismissed.
