This First Appeal From Order has been filed under section 173 of Motor Vehicle Act, 1988 (hereinafter referred to 'Act, 1988') by appellant being aggrieved by judgment dated 20.11.1997 passed by the Motor Accident Claims Tribunal/X Additional District Judge, Allahabad in M.A.C.T. No.606 of 1995 awarding sum of Rs.50,000/- with interest at the rate of 12%.
It is stated by learned counsel for the appellant that the parties who are related to each other have entered into a compromise before the Tribunal.
The appellant had challenged the order under no fault liability. Hence, the appeal has become infructuous.
Accordingly, appeal is dismissed as infructuous.
The statutory amount of Rs. 25,000/-, deposited in the Registry be given to Sri Sharve Singh, learned Advocate by account payee cheque who shall give it to the claimant as expeditiously as possible.
