Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri B.B. Upadhyay, learned counsel for the State is present.

The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 26.5.1990 passed by IInd Addl. Sessions Judge, Rampur in S.T. No.173 of 1989.

As per the office report dated 9.9.2022, a report of C.J.M., Rampur dated 5.9.2022 has been received stating therein that the sole appellant Nanhey has died on 31.8.2019. The said report has been sent after due verification.

This Court has perused the order dated 30.8.2022 passed by this Court and the report dated 5.9.2022 of the C.J.M., Rampur which states that the accused-appellant Nanhey has died on 31.8.2019.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
