Heard learned counsel for the petitioner and learned Standing Counsel for the State. Shri Praveen Kumar Tripathi holding brief of Shri Shobhit Mohan Shukla, learned counsel has put in appearance on behalf of opposite party nos. 2 and 3.
By means of this writ petition a prayer has been made directing the opposite party no.2 to take necessary steps for execution of the judgment and order dated 27.07.2022, which has been annexed as Annexure No.1 to the writ petition.
From a perusal of Annexure No.2, which is a notice dated 09.09.2022 issued by Real Estate Regulatory Authority, it appears that execution proceedings are going on.
In view of the aforesaid, we direct that the Real Estate Regulatory Authority, Lucknow shall expedite the execution proceedings and complete the same at the earliest, preferably within a period of two months from the date a certified copy of this order is furnished.
We further direct that in case execution of the order is not made for some reason which may result in issuance of recovery certificate to the District Collector, the District Collector on receipt of recovery certificate shall execute the same in the shortest possible time, in case of there being no legal impediment.
With the aforesaid observations and directions the writ petition is finally disposed of.
