1. This criminal appeal under Section 374(2) CrPC read with Section 27 of the Prevention of Corruption Act, 1988 (hereinafter referred to as "Act, 1988") has been filed against the judgment and order conviction and sentence dated 19.10.2012 passed by the learned Special Judge, CBI, Court No. 3, Lucknow in Criminal Case No.11 of 2002 whereby the appellant, Ram Mukesh Gupta has been convicted and sentenced for offence under Section 7 of the Act, 1988 four years rigorous imprisonment with fine of Rs. 5,000/- and under Section 13(2) read with Section 13(1(d) of the Act, 1988 five years rigorous imprisonment with fine of Rs.7,000/-.

2. Mr. Manish Kumar Gupta, Advocate, representing the appellant, has submitted that the sole appellant has died. He has tendered photocopy of the death certificate of the appellant issued by the Nagar Panchyat, Unchahar, which is taken on record and marked as paper "X".

3. Considering the fact that the sole appellant had died on 15.08.2021, the appeal is dismissed as abated. Let it be consigned to record.

4. Mr. Shiv P. Shukla, learned counsel for the respondent - CBI, is present
