The applicant has preferred the present contempt petition for non compliance of the judgment and order dated 26.09.2012 passed in Writ-A No 44284 of 2012 (Rajat Kumar Mehra vs. Union of India and others).

In para 13 of the counter affidavit filed by the opposite party dated 02.04.2013, it is stated that against the judgment and order passed by this Court dated 26.09.2012, the recall application has been filed on 20.12.2012 and since the petitioner refused to accept the copy of the recall application, the same was filed in the registry on 20.12.2012 with the endorsement of refusal. It is admitted by counsel for the applicant that till date, the aforesaid recall application is pending and only on account of the pendency of the recall application till date, the judgment and order passed by this Court dated 26.09.2012 is not getting complied with.

Heard learned counsel for the applicant and perused the record.

After going through the record, the Court is of the opinion that since the recall application filed by opposite party no.2 is pending, the applicant is at liberty to contest the recall application.

With the aforesaid observation, the present contempt petition is disposed of.
