Heard Sri V.K. Singh, learned Senior Advocate appearing for the applicants and learned Standing Counsel on review application.
The sole contention of the applicant is that in para 4 of the judgment dated 18.10.2021, it is reflected that Government Gazette dated 07.04.1990 records the property in dispute as a Waqf property, in fact, the same is not.
Learned Senior Counsel further submitted that the language of para 5 of the writ petition was to the effect that the Government Gazette dated 07.04.1990 did not reflect the property in dispute to be a Dargah.
Having heard learned counsel for the parties and from perusal of record, para 4 of the judgment is modified to the extent that the petitioners on coming to know that property in dispute has been recorded as a Waqf property in the Government Gazette, approached the authority by moving an application under Section 32/38 of U.P. Revenue Code, 2006 on 30.10.2018 for expunging the name of 'Dargah Kutubudin Shah'.
In view of above, the judgment dated 18.10.2021 is modified to the above extent.
Review application stands disposed of.
