Perused the record.
This application for anticipatory bail has been filed by applicant- Munendra @ Monu @ Munendra Singh in connection with Case Crime No.426 of 2021, under Sections 323, 324, 308, 504 I.P.C., Police Station- Mandi Dhanaura, District- Amroha.
At the very outset, learned A.G.A. contends that in view of the cross version of the F.I.R. giving rise to this application for anticipatory bail, the occurrence is admitted to the parties. The F.I.R. registered as Case Crime No.426 of 2021 has been altered to one section 308 I.P.C. As such, applicant does not deserve any sympathy of this Court.
When confronted with above, learned counsel for applicant could not overcome the same.
Having heard learned counsel for the parties and upon perusal of material brought on record as well as complicity of accused and also judgment of Apex Court in P. Chidambaram Vs. Directorate of Enforcement, AIR 2019 SC 4198, this Court does not find any exceptional ground to exercise its discretionary jurisdiction under Section 438 Cr.P.C.
Accordingly, the present application for anticipatory bail is rejected.
