1. Present revision has been filed against the judgment and order dated 05.08.2006 passed by Addl Sessions Judge/F.T.C. 11, Pratapgarh in Sessions Trial No.539 of 2003 arising out of Case Crime No.101 of 2002 under Sections 307/149, 504, 506, 427 IPC.
2. Trial Court after considering the facts, evidence and submission as well as defence did not find the charge under Section 307/34 IPC proved against the respondents beyond reasonable doubt whereas charges under Section 504, 506, 427 IPC were also not found proved and, therefore, the Trial Court acquitted the accused-respondents in the aforesaid case.
3. I have perused the impugned judgment and order of the learned trial Court.
4. I do not find that the learned trial Court has committed any error of fact, evidence or law while passing the impugned judgment and order dated 05.08.2006. The incident is dated 17.06.2002. Almost 20 years have gone by since the date of incident. Even otherwise, it would not be proper to remand the case for retrial and, therefore, at this distant point of time, this Court does not find it to be a fit case for interference in exercise of revisional power under Section 397/401 Cr.P.C.
5. Thus, this revision being devoid of merit and substance is hereby dismissed.
